I received a parcel yesterday which had been sent via parcel2go. The carrier was parcelforce. The courier arrived to collect the parcel and his scanner wasn't working - not a good start. The item was fragile and needed to remain upright. The courier was told this and said he would put stickers on it at the depot. Needless to say, the parcel has arrived with me, upside down, box bashed and contents smashed to bits. The address label had been stuck on the bottom of the box and there were no 'fragile' stickers to be seen. The sender of the parcel has contacted parcelforce who have told him because he sent via a third party, they will not enter into any discussions. They were the carrier though so ultimately it lies with them doesn't it?

Its actually the sender who has the contract with the shipping firm, not the receiver. I would also have thought that it would be the sender’s responsibility to label the box appropriately and put the address on the box appropriately? If this is a purchase, then your contract is with the sender and its them you should be chasing for a refund.
Yes, it is down to the seller to sort this out not you. It is the seller /sender that has a contract with the courier. You should claim damages from the seller and it is then down to him to try to get the cash back from the courier.
The seller has used an unsuitable delivery method so it is down to him/her to compensate you and then try to get the costs back from the courier.
