Divorce
My Partner is getting a divorce from his wife, it has cost thousands so far, we had the Decree Nisi about 8-9 months ago, then the solicitors started the financial proceedings as she is going after his pension, of which he has said all along she can have what she is entitled to. No property involved just his army pension. We have filled out our financial details, hers are all lies and when questioned she answered our questions with another question. We gave up on that and decided to take her to court to end and finish the divorce as quick as we can as we feel both solicitors are dragging this out and we are being took to the cleaners. Our solicitor never sends us any copies of letters sent yet charges us �100 a letter, ( average of �300-�500 a month every month and nothing to show for it) telephone calls and VAT are extra. In total we have spent about �4000-�5000 and their divorce has not moved from the Decree Nisi stage which was granted about 8-9 months ago. Also there are children involved, we would love to go for access but feel scarred that will bankrupt us as the wife wont even let my partner speak to them on the phone, except when she wants more money bearing in mind he has always paid maintenance for them, �364 a month, of which she did not declare and was done for fraud by the DSS and only got found out when she tried to get more money from my partner by saying he was not paying her anything. He has always paid directly into her account, he has statements to prove, so you can see she is not smart but she seems to get everything her way and we seem to be paying for it. Please help, we have just brought a house together, money is very tight and our solicitor said it would be ok to buy, the wife is not entitled to any of it, we have our doubts and would like a professional opinion to all of our queries above. I hate injustices and the children are also suffering, they have rights too. Thank you.

For more on marking an answer as the "Best Answer", please visit our FAQ.Unfortunately when you get into deep divorce proceedings it takes on a life of its own and it is very difficult to get things moving along and it is very costly. As you have the decree nisi then I would have thought that you are near the end and the absolute is supposed to follow on. I do wonder at the wisdom of buying a house before the divorce is final, and the financial settlement is not agreed. However if your solicitor says it is ok then I suppose that is a professional opinion . All you can do is hassle the solicitor and make it clear you need things to move along. Has she got a house? Has he got any other pension apart from his army one ? Don't forget, the solicitor is acting for you and if the pension split is agreed, then instruct him to draw up that agreement accordingly. There should be a proper settlement drawn up, how much maintenance he is going to pay, whether he is giving her a lump sum etc. etc. and something to ensure that it is all done and final with no comebacks.
