Arrested, handcuffed, bruised, man-handled then given a 80 pound fine
Hi, this morning I was disturbed at home by the police, they told me after trying to kick my door in that they had an arrest warrant for a Women of a different name. I showed my driving license to prove it wasn't me. Then they sat outside and waited for a riot van to turn up. They then knocked and arrested my partner. I was also arrested, for section 5 public order. I was slammed against the van, handcuffed with large bruises on my upper arm. I was then placed in a box van with tiny rooms. It has stale dried blood on the door, seat and floor. I was taken to the police station where i sat in this van for over an hour. They then came and told me i had 2 options. 1 was to take a fine and go or the other was go into the charge room sit in a cell for hours then be given the fine. I obviously took the fine.I walked the 4 mile home with sore wrists, back and arms. my partner was released 7 hours later with a NFA even the lady cid said He shouldn't have been brought in. What kind of force can the police use to arrest as there were no females. Also the penalty notice said I was given it on the street at 11.30 which is the time they arrested me not the time they releasedme which was hour and half later. Any help would be appreciated. Your version of events will undoubtedly differ to that of the Police. That's the first thing.
You quite clearly haven't given the full circumstances as to why they came to your home address. I speak from experience.
You don't say why your partner was arrested. And you don't say where you were arrested - in your home or outside in the street?
When they took you to the nick and you were still in the van, they obviously gave you the choice of the fine or being booked in and detained. You opted for the fine and were then obviously de-arrested and released - yes?
Police are allowed to use as much force as is necessary in the circumstances in order to effect an arrest.
If people fight, struggle etc, they may have to be forcibly restrained which can include being handcuffed.
If you believe that you have visible injuries caused by being arrested, you should go to the Police Station concerned, inform them that you wish to make a formal complaint, make a written statement and make sure that your injuries are photographed.
Don't forget, though, as I said earlier, the Police version will be different to yours, so unless you're adamant that they acted inappropriately, you may face an uphill struggle unless you have any independent witnesses of your own willing to back you up.
Consider carefully.

The police had an arrest warrant for a women that must have previously lived here. I'd never heard of her. They were very forceful on my front door as I was on my way to answer it. When I opened the door they called me by this womens name. I obviously said NO. They didn't believe me and had a warrant for my arrest. I protested my own name and showed id. They made a note and walked away. Never said sorry. 5 mins later they banged again and partner answeared they said he was under arrest for threats to kill his sister in law. ( my partner does not live with me nor was seen by the police the first time) I did protest that he doesn't have a sister in law, that the police had no right to be hiding in my back garden and that we have both done nothing wrong. I was this point at the bottom of my path. The police told me I was under arrest for breach of the peace?? I never kicked up a fuss although my partner was quite agitated in the van. After all we couldn't understand what they wanted. He was told he was wanted by police for this offence. I was forced against the van and handcuffed. I am a very slim women and pose no threat to anyone. I was then shoved into the van also and then we were driven out the street and round the corner. A police van turned up that had small rooms and I put in it. The room was filthy it had dried blood on the window, seat and wall. I was left inside this van before they came back. I by this time was in complete shock. I had a job to go to kids to pick up and have never had any dealings with the police. I accepted the fine because of the kids and work and the need to get out of that van and home. My partner arrived home at 6.30 with NFA which apparantly means no further action. They told he he never had a warrant out. That an allegation had been made by a ex sister in law after his brother had gone missing. A long story but she told lies to cause trouble of which she was found out but we still had to go through the humilation of all that.
I was arrested by two men one of which had arrested my partner he was on my right causing this pain. I have a large bruise on my right arm at the top. Lump on myhead and pain in my neck and right side of my back. I took the fine because of my job and kids. I have never been in trouble before and found this very humiliating. My partner was even brought back home by the cid lady who interviewed him.
hi crazydee, i hope you do get legal reprensentation. its looks like you�ve got a lot of coppers worked up, as i�d say all the people who�ve replied must be boys in blue, except me. parrafin �s the only one who spoke any sense. its your word against them. but if you are really adamant go 4 it. as 4 breach of the peace. sorry but isnt that the way all or most people react when wrongly accused and assaulted.

I have a complaint ongoing against the police - I believe what you say as thats how a lot of officers act - I take it we have all seen the G20 footage - You need to go to the police station and raise a formal complaint - you have 12 months to do this from the date of incident - you must take photographs of your injuries may be too late now.
The sergeant will try to fob you off by agreeing to local resoloution - they are very good at this - local resoloution is seen as a joke by polic eofficers - they actual say on police officer forums that you are not doing your job properly until you have section 9s (Think they call them) complaints against you.
The Prof Standards will prob not take up your case as you have taken the fine. nevertheless at least there will be some record against the officers. Maybe they have previous. By making formal complaints against the police is the only way for them to improve thier unacceptable behaviour.
And before the plod on here fart on - My younger brother is a police officer - I hope one of the decent ones.
