Car parking fine for parking on KFC

Could any legal boffins advise me on this situation. I have received a car parking fine from TPS for parking on a KFC car park in excess of 90 mins. I have pointed out to the company that all signs on this car park were obscured with snow on the date of the offence, obscuring any instructions as to any time limit for their facility. They have confirmed from the cctv evidence that my vehicle was in situ but are refusing to provide me with any evidence as to the state of the said signs, the ID of the driver, the person that issued the notice, or indeed the actual notice that was issued. I have explained that several people - family members - have access to my vehicle and do use their outlet at various times. I am unsure as to whether or not I should pay this fine or seek legal advice. Any comments gratefully received

I don't think it matters who was driving- it was the vehicle that was parked. However I understand that these penalty charges can't always be enforced but it can be stresful fighting them especially as you get threats of extra costs mounting up. Good luck

Don't pay.
If you give into their threats, thinking you can appeal later, forget it.
Am I right in assuming that you are the registered keeper? If so, and you weren't the driver, simply write to them saying you don't know who was driving at the time and the onus is on them to provide evidence of who was driving.
Even if they give a description of the driver from CCTV footage, you are under NO legal obligation to reveal the persons identity to them.

I must add that if YOU were the driver and are caught on CCTV, don't lie about it, but then revert back to your defence of the signs being obscured.

Don't enter into correspondence with them - just ignore them. They will keep sending letters with empty legal threats and will eventually go away.

They can't take you to court without evidence and they don't have any that would be acceptable to a court.

if the ticket was issued by the council or the police, you must pay up, then fight it if you think you have a case. if the ticket is issued by a contractor ,dont bother,just ignore them ,they might keep writing to you asking for payment, but dont bother,see www.MoneySavingsExpert.com and read their forums on this subject

Geoff- what if the ticket is from the railways? I understand there are bylaws which allow them to extract £50 off you for failing to park within a poorly marked bay

Been down this road with son and paid £1k & 6points. He said the driver was testing vehicle but couldn't trace driver.

The onus is on the owner to reveal the driver. Your car was on premises so road was clear; how would you know the signs were obliterated if you weren't driving?

Pay up or risk heavier penalties.

no chuck....my son's initial fine was £80 + 3points but he wasn't driving so challenged the fine.

It's risky for dennilson for the reasons I pointed out.

In brief, it is not a 'fine', do not pay them anything, ignore them and any subsequent stuff they may send you, keep any stuff they do send.
