hi, can i take my son to australia with out his dads permission? i havent been with my ex for nearly 3 yrs and our son lives with me, im the one that takes and picks him up from school pays for everything i do all the runny around as his dad lost his license (but thats a another story) ive been with my new now fiancee for just over two years were planning on getting married next year but we've been offered a new job but in austrlia its contracted for up to 2 years but can i just take my son or do i need his dads consent? our son was born in 2004 and his dad name is on the birth cerfitcate, look forward to your answers, i think!

Yes you do need Dads permission. You also need to think about the best thing for your child. Is moving him to Oz a good idea?

Just to add a little more detail to the correct answer provided by others:

If you do not have a residence order you can't take your son out of the country at all (even for a day trip) without the consent of his father.

If you have a residence order you can take your son out of the country for up to one month at a time without his father's consent.

You always require the father's consent to take your son out of the country for longer than one month.

could you come to an arrangement where he spends the school holidays with dad and you would pay for his chaparoned flights ???
i am presuming he is a good dad who plays an active role if so, its not his fault his child will be moving so should not be penalised, however it sounds like a good opertunity for you and your partner
