Another Get Out Of Jail Free Card...
Answers
No matter how the spin gets spun on this case (and I have no doubt some virtue signalers will defend the u-turn), the simple fact of the matter is the crime was considered serious enough to warrant a custodial, but because 'A Card' was played, the custodial was turned into a suspended. This is an absurd decision.

He can't go to a women's prison because he doesn't have 'certified evidence of gender re-assignment'.
His barrister then argued that he'd be vulnerable in a male only prison, so he shouldn't be sent there either.
The judge, obviously thinking it had now become too tricky for him to deal with, basically said - and I'm paraphrasing - 'oh alright I've changed my mind, maybe you don't deserve prison after all'.
So yeah, punishment avoided.

It'd be a whole lot less confusing if they stopped erroneously referring to a male as she. If they managed that they might be a lot clearer regarding which gaol he should go.
One ought not ask for a gaol to be built locally; they are better built well away from residential areas where any escapees would be more easily spotted before they reached civilisation.

Deskdiary - // If it looks like a duck, quacks likes a duck and waddles like a duck, it's a fair bet it's a duck... //
But if it looks like a horse, walks like a horse, neighs like a horse, trots like a horse, swishes its tail and ears like a horse …
it could still be an ass, or a donkey or a mule or zebra!!!
The world is a confusing place, standard norms simply don't apply these days.

I have no issue with people wanting to change sex - if that's what they feel they need to do to lead a more fulfilling life, then good luck to them - they have no bearing on my life.
But...
Decisions like the one in the link are patently nuts.
Surely it's not beyond the wit of Solomon to decide if somebody is a pre-op, they're jailed in a jail in jail with people of their born sex, and post-op it's vice versa. A quick look in this persons pants/knickers would quickly show where to send the person to jail.
Instead a violent thief is now free.
