ABH and Criminal damage to a 20 pair of Jeans
I need help. My boyfriend (38yrsold) and i went to the pub on Friday night and we talked about his dad. He left upset as it was his dad's annverisary in a couple of days time. His brother went after him and they carried on drinking. Anyhow later on about 10.30 he went to ADSA's to buy some matches. On the way in 15 youths 16 years old upwards started on him. He ignored it and went in, on the way out he said to the security guard "Can't you do something about them" The security guard said that they couldn't do anything. After that my boyfriend had to walk past them again, only to get confronted again by them. Jack ( my boyfriend) after this can only remember bits and pieces. He can remember being on the floor and trying to get up, holding on to something. Then he can remember two young blokes pulling him up and telling him to run as the police has been called. The next thing the police are there arresting him. Now 2 mins before the police had come i was walking towards ADSA's. And i saw Jack in the middle of about 10 youths. No security guard near him. He was arrested and charged with abh and damage to a 20 pair of Jeans. He was to have hit a bloke, but can't remember doing so. He pleaded guilty, and told them all of the above. The police say he has nothing to worry about. But i am. Now i know that he wouldn't have touched the bloke for no reason. But no one has said why.
Can anyone give me advice as, the defence case seems a little floored to me. And alot of the case doesn't add up. And does anyone know what the sentance would likely to be?

Unfortunately Norman is a grouchy old thing who is probably refering to the number of postings in which it is stated that the person concerned wouldn't harm a fly ordinarily, has put their hands up to the charge despite being 'innocent' and then other ABers being asked to second-guess the outcome of the case.
I'm not sure anyone can help you, really, as there will be more evidence, i.e statements, etc. than you are able to offer.
If the circumstances are as you have described then we can all only trust to the sense of the Court and hope your fella receives the correct outcome.

Thank you for that. I don't think my boyfriend should get unpunished for his behaviour and he doesn't think he should either. And he is going to plead guilt, despite not remembering all of what happened. I am going to just have to keep my fingers crossed, and hope you're right. The police have even said that he shouldn't worry about it.
Thank you again.
Thank you again.
