someone pulled out in front of me
3 Answers
basically i was travelling down a street, and someone pulled out in front of me from a side street on the left. he was turning up to the right (from which i was travelling)
the crash happened on the street on which i was travelling. (i hit the brakes, and my front driers side hit his rear drivers (corner of boot/bumper drivers side)
basically he admitted liabilty at the scene.
now when he infroms his insurance he says we were both to blame ??? how ? he pulled onto my road, in my path.
the only reason i can think of, is he is saying i was speeding. .... which i wasnt (and couldnt really as there was a sweeping corner a few hundred meters before hand) ........
bascially i believe that he is the one who has to make sure that the road is clear before pulling out.
would it be possible that his company will just pay up ? or am i going to court over this ?
either way im very confident, but it means i have no car for goodness knows how long, and its ver inconvient for me to have no means of travel.
any advice appricated ??
thanks

Sorry but you are liable!.
You are supposed to take note of all posssible situations including the chance that someone may pull out in front of you and drive accordingly. This will almost certainly end up as a 50 /50 split. He could even change his story and say he pulled out and then you hit him from behind making it 100% your fault.
Just report it to the insurance and let them argue it out.
Eddie51 sorry your wrong he is not liable ,i'm a driving instructor (6 years). He was on the major rd with the right of way so the person in the side rd should have waited.
Yes you need to be aware of possible situations but if someone pullsout in front of you where they were previosly waiting and you havent got enough stopping distance. How the hell can you stop its not possible.
Problem is mambo44 if you hav'nt got witnesses you need pictures or police at scene. if you havnt got that, then as Eddie51 says he could say anything (literally). But you are in the right for sure.

As a side note your damage would be consistant with what you say happened take picture asap.....insurance companys never admit liability so dont worry about that....just get as much evidence as poss and let the insurers work it out...unfortuantely if your insurance dosnt give a courtesy car then you have a transport issue for a while at least.....speak to your insurers about this and possible compensation.
