Whos fault is this car accident???

me and my friends were parked in a car park. i was in someon else car talking. My other friends were handbreak turning and messing around in there cars all around the car park.
i decided to go, i got into my car and my friend was in his car next to me. he was parked!
i done my checks and started reversing.
Then suddenly my friend reversd sharply behind me, and the back of my car went into his!
my car is ok, but his has got a big dent in the side and the door is crooked.
He was also not alowed to be driving as he came out of hosptial two weeks ago after an operation on his toe, so it was in a cast!
of course i got the blame and he said my insurance should pay for it. im only 17 and hes 19.
whos in the wrong? and who should pay?

let your insurers decide.
hes not allowed to drive. so the way i see it is that its his fault since hes in a cast an his driving ability would of been hindered in some way
If he wasnt allowed to drive and considering his toe was in a "cast" ????

ok, so would it be his insurer then?
because if he tried mine they would refuse cause he was in a cast right?
as i said, call your insurer and get them to sort it, thats what you pay them for isnt it!

Anyway back to my question..... So if i told my insurer and they said it wasnt my fault would it just go back to my friends insurer?
Rollo does have a point, it's pretty sad to hang around in car parks. There is one near me where all the idiots go too, and this kind of thing happens.

im 17, in a small village and theres naff all to do. i dont wanna sit in a watch tv all day and we cant have people over all the time and we dont all have money to spend so wat else is there!

your insurer will contact your friends insurers and they will ask you for a report. give all the info.

btw, the stupid tricks your friends were playing has no relevance to the question, so i cant understand why you are getting annoyed that people are mentioning it.
i have to say that even 1 of these handbrake turning cars off the road is better than nothing.

ok, well it does have relevance because it shows that my friend was reckless driving so surely that will back me up?
I believe if his foot was in a cast then his ability to drive was impaired and therefore shouldn't have been driving at all. Either way you can probably add another zero to your insurance premium next renewal.
But on a completely different note, it is idiots who think they can drive that puts insurance dividends up for the rest and the reason why my son ( a very careful and sensible driver) is paying almost �2000 per year to insure and car worth �500.

ok, right. why would mine go up then? if it was his fault?

and i am a careful driver, my friend was being a total idiot and was showing off! and it ended up his car being damaged, so he got what he deserved.

It was abandoned/Empty? So what? my 'Friends' used to go out robbing, and commiting crime, hence why they are no longer my friends, as i didnt want to be implicated with those sort of people....

look, im not asking for sympathy, the only reason is to check who will be paying for this? and whos fault it is more?
i know it was both of our faults but the insurers dont see it like that!

i dont want all your life stories i just want you to answer my questions!
how about grow a set of balls then and speak to your insurer.....end of story...
Both of you will end up paying. Accidents on car parks usually end up being split liability and the rules of the road dont apply.

One bonus is that your premiums (if u actually pay them) will rocket so you will be severely out of pocket
