A friend of mine is a delivery driver at night for the local chinese restaurant. Last night on his last delivery he put the �22.00 in so he could go straight home afterwards, he went to a house and the guy grabbed the food and bolted his door. My friend banged on the door and shouted through the letterbox to hear laughter and people jeering for him to **** off. As it was his own money and he was annoyed at what at happened he called the police,. they said there were no cars in the area and would be about half an hour and he was just to go sit in his car. He did, when 2two guys came out of the house brandishing a bat and a knife, my friend jumped out of the car with a hand batton (he kept for protection) but he was taken down by the two guys and set upon, when the police arrived the two guys ran away and they helped my friend up, he wasn't badly injured more his ego than anything, the police asked what had happened and who was the owner of the hand batton, he said it was his and he used it for protection and up until last night had never had to use it. They arrested him and he spent the night in the cells for possessing an offensive weapon he went to court this morning and was let off with a caution. WTF is the world coming to????

A weapon includes a baton, and a public place includes a vehicle on the highway.
If he kept the baton in his vehicle,he doesn't need it for self protection. He could have got in to the vehicle and driven off.

You've answered your own question, "How did he take the law into his own hands?" in your original post where you said: "my friend jumped out of the car with a hand batton(sic)(he kept for protection)".......
1. The fact that he had that weapon means in law that he's in possession of an offensive weapon.
2. By jumping out of his car with it to confront the other guys is taking the law into his own hands.
3. The very fact that the others were armed with a bat and a knife is no excuse for your mate jumping out of the car and doing what he did. Why didn't he just drive off?
4. There's clearly more to this than this version. I'm speaking from experience of such matters.
The laws of the land are not designed for do-it-yourself merchants. What would have happened if your mate had come off second best, or, God forbid, been killed? You'd then have been mourning instead of moaning !
