Can I claim after being cleared of assault?
3 Answers
Hi my problem started on July the 10th 2010. On this date I went to pick my two children up from my ex wife's home. After a disagreement between me and my ex wife her new partner came to the door and grabbed me. A fight ensued during which I was dragged into a window which resulted in me suffering a 5cm laceration to my left should which needed a visit to A&E. while I was traveling to the local hospital my ex wife phoned the police and told them I had started the fight. I was arrested two days later and charged with common assault and aggrivated entry into a property. In march this year I attended court and was cleared on all charges and when summing up the magistrate said that she found my ex wife's new partner to be the aggresor. I feel that throughout this entire incident I have been victimized not one was I offered any support and even when I was found not guilty, which the officer dealing the case sat and listened to, I was offer no advice. I feel I deserve to be compensated I didnt start the fight and I had to have ten stiches in my back which has left a scar. It seems wrong that because they rang the police first I dont get a say. Any advice would be greatly appreciated.

Provided the prosecution was promptly brought neither can be held liable to compensate you. You may have an avenue open via the civil courts to seek compensation from your ex wife and/or your new partner if you can show their actions were malicious or blatantly false. However, you should seek legal advice as this is by no means straightforward.
