Can I Change Company Of Sheriffs Who Collect Ccj ?
Hi,
I paid a company of sheriffs June 2020 to collect on a CCJ issued in 2019 but they're useless ! They did collect some of the debt last year but the debtor hasn't paid even reduced-by-nearly-half agreed payments in over 6 months, I just get an e-mail every week saying they're left a[nother] vm or sent a[nother] e-mail to him saying settle the debt within 5 days to avoid further action. Every week's the same, no payment, same e-mail sent, they will not try to visit now.
I know you take it with a pinch of salt (I get they probably don't show the fails) but the sheriffs in the newer tv programme about this do seem to be more persistent.
Can I switch ?

That you agreed with them. I dont think they are officers employed by the court but officers who are empowered by a court and live by collecting fees - from anyone who has said 'yes'
in which case - - - they may wish to be paid for work done ( yes visiting and sending emails )
I was offered payment only of the debt by a debtor ( £600) when the fees topped £2000 - and said no - because I thought they would come after me for the extra 2k
They have to live.

Don't have the contract to hand but I do remember it saying that if they didn't recover anything I'd be charged an extra fee. It also said their costs would be deducted before I received anything. Not true. The debtor did pay to start with, a few £100. Whether it was because, at the time, they couldn't visit due to Covid restrictions so couldn't action the writ as they would've normally, I don't know, but they did send me a few cheques so both of those statements have been invalidated as far as I'm concerned. I've actually got back more than I was ever expecting (given that I thought the Sheriffs would take their £1000 worth of fees first), but I don't understand why they're not making a greater effort to even get *their* money back.
barry1010, the debtor's self employed so must have a vehicle & tools at least, the Sheriffs haven't been in the house. He told them he wasn't working so couldn't pay, then later said he'd lost his job so couldn't pay. It's all lies. His missus works too. I've seen photos of work he's completed, pics of jollies he's been out on with his mates (which I've sent to the Sheriffs over the months) ... he's just laughing at the Sheriffs, & very likely pulling the same stunt he pulled with me with other people at this very moment.
I'd just like to know if I can "sack" these Sheriffs & try another company.
