Demise of garden

We have own a converted victorian leasehold flat, which is called Garden Flat. When guy moved downstair, his solicitor told him that we actually own the garden, despite we are not a freeholder of the building.


My common sense told me that the freeholder own the land, therefore, he owns the garden.


So, I looked at our lease. Under the fourth schedule "rights included in the demise", "The right of access to and through and the right to use the garden of the building in common with the owne of the garden flat in the building". Does it mean that we own the garden?
