I live next to a piece of land that was once owned by the Council. there is a planning application to build a pair of semi detached houses on the land. The access to the site is very narrow and it is proposed that a strip of land, about 3feet wide, is taken from my garden to widen the access, I am told that somewhere along the line a previous tenant has included the land into the garden. To my knowledge, the garden has always included this land and has for at least 35 years, I delivered the post in the village for 25 years and have been retired for 14 years and the garden has always included this strip of land. I have been told that in law if it has been like that for 12 years or more, the land belongs to this property, can someone tell me if this is true.
