How long can you keep a band name?

Are there any criteria where a band can take the name of one that previously held it. I would assume that there may be instances where a name may have been copyrighted ie the Beatles, but other ones like Mr Big ( Romeo from 1977 and a completely different band (To be with you 1992) have taken over the name. Is there a period of time in which a name can be used by someone else ie when a band officially disbands or a set period after.

The second Mr Big probably had one member who took over the name. Bit dodgy if you ask me if he is the only original member. It does sometimes result in court action. In answer to your question i think copyright lasts 50 years, by which time it is hoped nobody will be interested. However, if you tried to call yourself The Original Storyville Jazz Band it could be called deception even if they are all dead.
