driving with no isurance(unaware)
i was recently pulled over by the police and accused of driving with no insurance,an offence which i catergorically denied.they also proceeded to breathalise me,before we go any further let me state my job dictates i must have a driving licence and for me to purposely commit either of these offences,would deem me insane!obviously the test proved i wasnt over the limit,yet they continued to carry out pressing charges regarding no insurance.my car was not recovered/impounded and i was informed once they had taken my details,fingerprints,d.n.a swab at the station(can you believe it!).i could go back and collect/drive my car home from where i was initially pulled up,even though they have just pulled me for no insurance(laughable).the following morning i rang my insurance company(hastings) to find out what the hell was going on,to be informed due to a missed payment(last month) my insurance policy has been cancelled and was informed by letter about this.which i never recieved.asked if the letter was sent by recorded/signed delivery,told no as this was not company policy,also no attempt was made to either phone me or e-mail as this not company policy either!having been insured with hastings for over 5years and having 7 years no-claims bonus is further proof i have always maintained a stance of ensuring i am always insured.if anyone has either experienced a similar situation or any advice regarding mitigating circumstances to reduce points/fine i would most appreciate it,as this could now dictate whether or not i keep my job,something which seems very harsh for a financial oversight.

For more on marking an answer as the "Best Answer", please visit our FAQ.Hi, due to the seriousness of non insured can be & payment was controlled by yourself via funds in your account, the bank can only pay what you have agreed, if you where overdrawn etc, your bank should have advised you by letter, in reference to what you have stated even in mitigated circumstances I do not think that will help you even if you take it to court, the advise if I can offer, get a letter from your Insurer stating that your payment for the duration of time you have been with them has been prompt, this MIGHT help you, also a letter from your bank to the same effect, with respect to the police, the where only doing what they are paid to do & in your case the V R I give out the info of non insured of which they car was, regards the Breath test, that is the case nowadays, as regards the Finger swap etc, that is a question that I would want answers to, Eg/ are you from the UK? do you follow the lines I am going?
The bad news is that you haven't a leg to stand on. When you took out your insurance you entered into a legally binding contract including payment.
Basically, if you've defaulted with your instalments or payments, you have in effect breached your contract, hence the reason why they cancelled your policy.
I think you may be looking at a fine and possibly 6 points on your licence for driving without insurance.
