Charged with ABH please help
6 Answers
I was charged with ABH in February this year. My wife is claiming I kicked her between the legs nearly a month prior, she assaulted me. My wife of 20 years has severe PMT and has a serious drink problem 2ltrs of vodka per week. This is pure revenge as a result of my ending the relationship due to her behaviour. She has always been volatile and impossible to speak or reason with you tread on eggshells and end up apologising to keep the peace.
I sent a long email covering lots of points and the true account of incident, because I put i'm sorry i kicked you so hard i was in bare feet the police see this as a confession. I explained i sent it to appease her following her sending me a text photo of a bruise on her backside. Despite the police claiming it's a confession they took a 2nd statement where she claims i was wearing trainers or crocs? She fell backwards after 1/2ltr vodka following kicking me in the groin various obstacles, we lived on a boat.
She now claims I have been violent towards her for 10years, I haven't she's turned the tables, got a council flat within 8 weeks, we have no children 5 dogs.
Previous barrister said PMT would offend jury request was made for med records regarding her drink problem (still not produced) in July CPS lost defence statement and requests. Her 3rd statement claims she never had a drink problem! Was advised to plead guilty to kick only told photos, med report and email i'd be looking at 2years! Declined this but police offered to drop to common assault if I plead guilty prior to going into court.
She claimed numerous other injuries in her statement claiming they'd healed but other than her bruised groin none were present on a GP med report. She has made countless lies most of which I can disprove. I'm 40 with no previous.
There is more info. Please help even if its only to recommend a quality rope and knot to hang myself with.

i dont really understand your "im sorry i kicked you" email if you didnt actually kick her. Surely if you were far enough away to be comunicating by email, then you didnt need to say this to appease her?

I feel very sorry for you, and can't believe that the police and the prosecuting authority are wasting their time and our money on what sounds to be a fairly trivial case.
You mention that she had previously assaulted you. You also mention that she'd had 1/2 a litre of vodka when she fell over. Could it be at all possible that given her history of violence towards you and the fact that she had been drinking heavily (therefore rendering her behaviour as erratic and irrational), you felt that there was a possibility that you would be attacked and therefore acted in what you believe to have been reasonable self-defence?
