Hi Guys,

I would like to take a craft course in usa in july 2011,the doubts i am having are is this the best way to gain entry to the usa,i have a conviction for abh in 2004 since i have not been in any trouble,is this classed as moral perpetude?also i am currently unemployed due to a 5 year period were i cared for my mother who died in nov 2009 from dementia, at the time i was a full time carer and since its been difficult to gain employment my age is 55,i am worried about these two issues,i did send of for a acpo report which has been returned so i now need to contact the embassy for interview but i am worried about being refused a visa...

Assault is only classed as 'moral turpitude' when it is
(a) with intent to kill;
(b) with intent to commit rape;
(c) with intent to commit robbery;
(d) with intent to commit serious bodily harm; or
(e) with a dangerous or deadly weapon.

The Foreign Affairs Manual of the US Department of State specifically states that an assault "which does not require an evil intent or depraved motive, although it may involve the use of a weapon, which is neither dangerous nor deadly" is NOT 'moral turpitude'.

Your conviction for ABH might still result in you being refused a visa. The only way to find out is to attend the interview and to see what response you get. However I can see no reason why either your age or your employment history should have any adverse effect upon your visa application.

Thanks BUENCHICO,i will not take a risk and apply to get a visa for the usa,i looked on their web site and you can download your details i think its ds -160 the only problem i have is the photo,i printed of the ds-156 doc do you send this of to the embassy that way i can get a standard photo booth pic not really sure on this and its not easy to find out on their site can anybody advice who as done the visa application thanks for you help...chris
