ebay ripp off ??
hi, i bought an e-tablet from a person on ebay, it was a basic cheap unknown brand for 125 pounds,new. the 'free' keyboard did not work, the tablet was unresponsive when i pressed it etc, when i pressed the letter 'a' i got 'q' and the battery only lasted about 30 mintes. so i emailed the seller and asked for a refund due to it not being as promissed and not working s it should, he replied that yes he would give a full refund provided i returned it as i received it with everything included, which i did. the postage cost me nearly 11 pounds!!. anyway he has now emailed me back today saying that he got the item back but apparently the screen is chipped due to my packing, and suprise suprise i cannot have a refund as he would be unable to resell the item!!.
i emailed back telling him that my packing was not at fault and how could he sell it again as it was faulty in the first place? i have threatend to report him to ebay buti just wondered do i actuall have rights? as he claims it was my fault the screen is dammaged? is this worth persuing? i am really cheesed off about this as i cant afford to loose this money. julia (juhurst27)

Make sure you send an email sayinmg there is no way it could have been broken as you packaged very well and it could be that he has damaged it. You will not get the postage back for returning the item but you should get the item value plus original postage.

Unless they have changed significantly eBay does not always favour the buyer. In my experience as a seller they have always favoured the seller even when the con was obvious. Always finding some excuse to wash their hands of anything.
My suspicion is that your best option (one you've given up on eBay and/or Paypal doing the right thing) might be to contact the seller and give them a date for refundung your money else you will be taking them to the Small Claims Court. And mean it. (You can fill out the form on the Net.) But why not talk it over with "Citizens' Advice" first to get a further opinion ?

Sorry Old_geezer but you are talking rubbish .
juhurst , just go to the item on your ebay page and on the drop down menu there is an option ' Solve a problem' click on that and then on 'item not as described' there is space to put a message saying what is wrong and what you want done. Ask for a full refund of the price payed and the postage costs.
If the seller has not refunded you within the time limit , I think 7 days , then you click on 'escalate to customer support' ebay will look at the case and refund you in full . Ebay will actually take the cash out of the sellers paypal account and put it on hold as soon as you put in the 'not as described' report.
If the seller does not refund you himself ebay will do it and the seller will get a warning , 2 warnings and ebay will put a limit on his selling , another warning will get him banned.

Smoball you can't have both, either you have the item or the refund. By accepting the damaged item back juhurst would be turning down a refund.
The seller is wrong this belive me, ( with 905, 100% posative ebay feedback I do know what I am talking about. ) ebay WILL find the seller liable in this case and will give juhurst 100% refund.
