goods received in error

we ordered some items from mail order and as a thank you we were suppose to receive some chocolates. Instead of the chocolates as displayed on the advice note we received a very expensive electronic gadget. Please could someone tell me is this a human error in our favour or do we have to return.

The company are collecting tomorrow. The person who was awaiting the item has contacted saying all they have received is a box of chocolates (well the advisor was limited in what she told me due to data protection). Also a new box of truffles is on its way to us. A 40% discount on the order that I placed has been applied (i thought it was on future order), but...

Do tell us, what is the 'expensive electronic gadget'?

To you it may appear expensive, but to the mail order firm it may have cost less than a box of Belgium chocolates.

Get matters resolved with a telephone call.

@joko, it was the only item received and the advice note state celebration chocolates
sorry cheapie i dont know the answer but i WOULD keep the item. If the advice note says a box of choccies, how will they ever prove they didn't send chocolates?

There is no legal right to a reward but you can ask for one- they may send a small gift as thank you for the inconvenience

I know you didn't ask this but I couldn't use it in case I damage it and they then ask for it back or its use is traced to me
it would be bad karma to keep the item regardless, so i would phone and find out ... if it is a mistake they have to pay for collection!

well as some have stated - just put it in a cupboard and see if they ask for it back

@cath - It is the choccies I am annoyed about, was looking forward to scoffing them this evening. LOL

@joko, yes hundreds which is why I feel I am saving them quite a bit of money by returning. Although it may be worth pence to them it is not something I could outright afford without it being a treat.

btw, i once told a government agency that there had been a mistake - but not in *whose favour* - and was told quite rudely that there was no mistake and that matters had been checked and signed off by a manager ...

kept the money for 6 years then spent it! lol!
As far as I'm concerned it's unsolicited goods. I think the rules still say that as long as you tell them you want them to collect the item, if they don't collect it in six months it's yours. anyone else think his?

cheapnchic, I can't understand why you don't tell us what is the electronic item.!! Perhaps it's a box of chocolates which have been packaged to look like a smart phone....Have you tested it to see if it works.?

where is the company based?

if its very far away they wont want to collect it - you could just refuse to post it back - incovenience, cost etc - even if they send an envelope youd still have to go to the PO.
they could send a courier but might cost too much

And I don't understand why you want to know. If she wanted us to know she would have told us.
It makes me wonder how people can go on about benefit scroungers, etc (not saying it has been mentioned on this thread), yet a vast number of people want something for nothing and think its ok. From a legal point of view, I thought you had to inform the company and for them to tell you how they would like it returned, it's not like finders keepers.
I once took delivery of a very expensive phone on behalf of my downstairs neighbour. Took it to her that evening and she had no idea about it! Turns out it was delivered to the wrong block of flats. I did try to contact the vendor, with no joy, so kept it for ages not knowing what to do! Finally gave it to my nephew. :-))
