Ebay Problems Yet Again

im really getting sick and tired of buying with ebay now. latest thing is that i bought a watch, then i changed my mind after paying as i found out the watch face was way too big ( diesel baby daddy watch ) so as the seller had not yet posted or supplied me with postal / deliver/ tracking details then i requested to cancel. he ignored my request to cancel and stated that the watch had allreay been posted. im certain that the original listing stated that returns were accepted, now today when i want to return the watch the ad states " no returns accepted " where do i stand on this ? what are my rights ? i know i will have to pay for return post but is there any way i can return it ? i have been on ebay 5 years now and have excellent buying record with no negitive feedback in those years.

Really the time to decide whether you want something or not, and to research your item is before you bid not after. To my knowledge you can't retrospectively change your returns policy on an item already sold, so you'll just have to list it yourself if you don't want it. Trying to be nice here but really please make sellers lives easier and don't bid on things unless you are sure you want them.

I doubt anybody can change the conditions of an auction after a bid has been placed. I think you may be stuck with it. You could just sell it on again.

In general, the rule is that you've no right to a refund (or exchange) on a non-faulty item just because you change your mind (or because you've made a mistake). If you buy something in a shop and, only one second after purchasing it, see that you've picked the wrong size, the retailer isn't obliged to do anything about it. He can simply tell you that the purchase contract has been concluded and to go and get knotted.

However if you buy online from a trader then the Distance Selling Regulations apply and you can return the goods for a full refund within 7 days. However the DSRs don't apply to private sellers. So whether or not you have the right to return the goods depends upon whether the seller was a trader or a private seller.

If the buyer says they don't accept returns, unless of course the item is faulty or not as described, then they don't accept returns. Why should they?

The original listing will still be available for you to look at, if it had been changed after you'd started bidding on it, you would have been alerted to this.

Why didn't you check before you bid on the size of the face? It's not the seller's fault you made a mistake.

I don't see why you should be "sick and tired" of buying on eBay on the basis of this, which is your error, not the seller's, according to your description.

UPDATE...watch arrived today, its really nice, looks well. i left the guy very good feedback. anytime in future i will study the item description. in my favour it did not say too much on description of watch but i will learn one of these days to not rush in and buy.

My recent experience with EBay...won auction, paid immediately, received e-mail from seller that the price was too low, he wasn't sending it and was going to re-list. He did and EBay let him. I got refund and he sold the watch for LESS than my initial bid! There's obviously something about watches and Ebay.....!

dick, I'm glad it was a good outcome. Next time, you can always send him a question about the item - if I forget to put a measurement on my listings, there's usually someone emails me to ask how long or wide the thing is :-)

boxy: yes, I did "raise a case" with EBay to inform them and to get my refund...doesn't seem to have had any effect though. I got my refund (although I would have preferred the watch!) but they let him re-list it ...which I thought was poor.

boxtops, if the seller is a trader then he is legally bound to accept returns - stating he doesn't will not change the law.
