Hi

I purchased an animal adoption package ' In Good Faith' from an EBay seller on 22/04/14 for my young niece but have been incapacitated for a couple of months and when I attempted the other day using the WWF activation code, the WWF informed us that the adoption is not valid & expired in 2006!!!!

I spent almost an hour on the telephone to WWF trying to sort this out for my niece, but they were unable to help

When I contacted EBay, they informed me that, I couldn't really legitimately claim a refund, because I had to do this with items that were 'Not fit for purpose' within 30 days from purchase date, but I wasn't aware of this

Surely the Sale of Goods Act offers further protection than this!!!

Is EBay bound by this?

My young niece is really heartbroken as she was so excited about helping out Orangutans

I would really appreciate some advice if any one can help

Have you tried contacting the buyer directly?
I looked on ebay forum and they said after 30 days your only option is to contact seller and if no joy, trading standards.

Hi

Thanks for this

The seller is going to seek advice from EBay, but they will be told the same thing as me. Surely this isn't right. My young niece is really gutted!!!
Is the seller a private individual or a trader?
Question Author
A private Individual I believe
Was an auction listing or buy it now?
Question Author
Buy It Now!!! Does that make a difference?
Yes, it does.

With a private seller the SOGA requires the goods to be as described. What exactly does the listing say?
Your contract is with the seller, not with eBay, and your right to a refund in respect of goods which were not 'as described' (i.e. a valid adoption package) is not time-limited (other than you'd be unable to pursue it through a court of law if you didn't take action to get your money back within 6 years).

Hassle the seller!

In the meantime consider paying £3 per month (or a lump sum of £36) to 'adopt' an animal for your niece directly with the WWF:
https://support.wwf.org.uk/
(If you go for the monthly option, an Extra £1.50 per month will get your niece into the Go Wild Club).
