Tk Maxx Return Item For Refund Or Exchange ?

i bought an item from tkmaxx, i noticed a defect today, i looked at reciept and it is out by 28th august, just 4 days ago , reciept states that item can be exchanged or refunded anytime before this date.

since item is damaged due to no fault of mine can i get an exchange ?

Go back to the shop and find out?....they could argue that you've had the item for a month and not noticed the fault -what is the fault? has something come undone like stitching or a zip? or is it something in the manufacturing process? IF its faulty then they may give you a credit or exchange depending on whats wrong with it.

yes, it is the stitching coming away, no big deal , about 2 inches on arm of jacket, yet so, its still a defect in the clothing.

I think that the time limit is if you want to return the item because you've changed your mind, or want a different colour etc....NOT because there is a fault. If there is a fault, you are covered by consumer legislation...and they should replace or refund.
