Ebay Selling

If i advertise something and put on description part 'no refund or returns', does this stand, and can the buyers demand a return and refund if they are not happy with the item.
I have some makeup on Ebay and it isn't the genuine brand, and it isn't advertised as being the genuine brand and i have not put a brand name on the advert, so if someone buys it, they are doing so purely on the basis of the advert i have put on. So do they still have a leg to stand on.
Please note i am not selling dodgy makeup, just the package is copies of the more expensive brand. x

I only advertised the product as the kind it is i.e powder/creme etc..I don't think it should be an issue, they are selling dirt cheap, and if common sense prevails to these customers, they would know the more expensive brand would never be that cheap.
It doesn't prevail, though, phleb, and a lot of auctions start at 99p irrespective of what the final price is. If a person buys it then finds it's not the real thing, they can kick up merry hell with eBay and get you into trouble as a seller. Although you say no returns, if it's not fit for purpose they'll still be entitled to a refund if they are buying what they see in the pic, and it isn't that when it arrives. Personally, I wouldn't take the risk. I value my eBay rating too much to compromise it by selling copies.

Under the distance selling laws you have to accept returns. You can put whatever you like on Ebay -no returns, buyer pays for returns etc but you are bound by Ebay terms and conditions to accept returns, If your seller reports you for an item Ebay will MAKE you accept the return and tell you to refund -if you ignore Ebay they will deduct the amount from your Paypal account or the debit/credit card you use. Selling fake goods is illegal and you could be prosecuted. If I bought expensive makeup from you and it turned out to be knock off *** I would report you.
