Can I be "ambushed" by UK Court?
A Canadian court granted me Joint Guardianship and Joint Custody with primary residence in Canada for my seven year old daughter. There is a criminal case against her stepfather for abuse. If I am able to obtain a court order changing the residence to the UK, can I be "ambushed" by my ex-partner (child's mother) in a UK court despite the Canadian Court's decision? (Haig convention notwithstanding)

For more on marking an answer as the "Best Answer", please visit our FAQ.I'm no expert, but from the little knowledge i have, i would say Yes she could because you have been granted Joint guardianship and custody, It may be different if you had been granted sole guardianship and custody. You really need to get in touch with a damn good solicitor - i would have given the name of mine but hes a good as a chocolate fire guard im affraid.
