Vaccine Error? Medical Negligence ??

On Thursday I went for my annual flu and Covid booster as I found out it was the Moderna, and I had 5 Pfizer jabs I decided I would just have the flu jab and come back at a later date. I know several people including my mother who had a bad reaction to the Moderna. So I spoke to the nurse I told her very clearly it was just the flu I was getting, she seemed quite distracted and really not quite with it, when it came to the injection she injected me and said so just to confirm you are having the Covid injection and the flu. I asked her what she was doing. She quickly pulled out the needle and discarded it, saying that no vaccine had gone in and proceeded to give me the flu jab. She went and spoke to her manager who confirmed that the syringe was withdrawn before the vaccine had been plunged and it was just my skin had been pierced. They were recording it as a near miss. It wasn't a near miss regarding the bruising on my arm!! They told me I could come back anytime next week without an appointment for the Moderna, I told them highly unlikely, I asked them for the complaints procedure to which they gave me. I then asked them about the Pfizer, they said in my region it was only available to under 18s unless in exceptional circumstances for adults, well I suggested she make an exceptional circumstance considering the nurses stupid mistake. I said that if she was to arrange the Pfizer for me I wouldn't put in a complaint in!! I help her if she helps me ! Good negotiating tactic I think! She is going to look into with it with the authorising team on anxiety grounds, so maybe? Is there in some way I could sue or claim compensation for medical negligence or assault? Surely if I was in America I could sue them for thousands! I have half a mind to pay privately to get the vaccine it costs about £100 and claim it back from them saying I have lost all trust in them

Hopefully there is no mechanism for you to sue for something which nearly happened....but didn't.

You have no evidence that you would suffer ill-effects, in any case.

If you are so concerned about the free, voluntary covid injection, perhaps you would be wiser to give it a miss all together?

Douglas I am actually in my final year of my open university degree, good point maybe I do and should have better things to do. 
I do worry about COVID because last Christmas I lost a very good long time friend to it

How terrible, was it a large bruise? 
Please let me know how you get on as I have bruises all over my arms and hands where the nurses could not find veins at hospital.

If you convince them to give you what you want then fine. But somehow I doubt anything will achieve much if you don't.

 

A complaint will probably end with the nurse being ticked off for not paying attention and told she must do better in future. Lessons learnt. Any legal challenge is likely to be dismissed in my unprofessional inexpert opinion unless you could prove a major health issue due to having received the aborted vaccination. Which would be difficult to prove a connection to.

 

How would they be liable for any £100 you voluntarily and unnecessarily spent ?

 

Yeah, American sue culture is ridiculous and hopefully one of the possible adoptions UK citizens finally choose not to adopt. It'd make a change as most of my fellow citizens seem overkeen on replacing UK culture with American.

You may have lost confidence but you can get the COVID jab free from many pharmacies including Boots. You don't need to pay privately.

Gordie: Did you come to any harm? If not, then why would you want to take up NHS time chasing compensation for nothing, when they should be doing their job of trying to protect the public from illness?

Would that be their fault because their guidance says you shouldn't have received it or would it be your fault because they were blackmailed into doing so?

The corbyloon highly unlikely. I have had 5 Pfizer's before and never had any reaction. I am seriously considering not having it. I mean surely I must have some immunity left. I have had 5 Covid jabs plus I had Covid in 2023 I took it very mildly 4 days of feeling rough and then a bit better then negative day 6 and 7.

As I see it the problem is did you or did you not receive the Covid vaccine. Did you see the syringe before it was thrown away? Can you be certain that no vaccine entered you arm.
Did the nurse actually touch the plunger on the syringe? I personally would not have another injection without being certain I did not receive any. Re bruising this often occurs as we get older. I bruise from any little bang or knock. The needle probably hit a tiny capillary thus causing the bruise.

I haven't been for it. It was something I was considering. All the places I've looked at for Covid jabs including Boots etc you have to pay. I got the flu jab and had this problem at a vaccination centre.
