looking for some help before approaching our lawyer' my partner has a 13 yr old child from a previous relationship nd his ex kept tryin to take her abroad to live so we went to court and had an injunction put in place so that she cannot leave the counrty without his permission. This year the daughter decided she wanted to move abroad with her mother so to avoid causing a fallout my partner agreed to let her go and signed to have the injunction removed. His exes lawyer said he never recieved this letter but she went anyway now things are going wrong abroad for his daughter and he wants to try and get her back over here but as i said he signed to remove the injunction.Since her lawyer never recieved the letter will the injunction still be in place even though he did sign it and his lawyer sent it to hers?? A bit confusing i know but any help would be appreciated
i don't know i'm afraid. However, does it matter> if the injunction IS in place, how will that help apart from getting the mum in a whole world of trouble on top of what's going on abroad? If it ISN'T in place, he will still do something, wont he?
he will still do what ever he can to do what he thinks is best for his daughter, we are just unsure because of the whole mix up with the injunction. We dont want to make things worse with his ex cos they are pretty bad but he will never give up hope for his daughter its all a bit of a mess to be honest!
thank you for ur answer
Is she a ward of court ?If so, her name should have been on lists at all ports and airports, to stop her leaving the country. If she was not stopped, that suggests that her name was not on these lists. Go to the Citizens Advice Bureau in the first instance for advice on where to go next.
