Restraining Orders - Please help.
Hi.
My son (16yrs old) was attacked at school last Thursday, this attacker also assaulted my other son last year. The attacker has now been expelled from school following the attack, he was arrested and is on police bail until April, however, last night he sent my son a message through MSN with a death threat (my son had forgotten to delete/block this person from his contacts, however we have now done this). The police were called again, I visited the school this morning to advise if they see this person they are to call 999 immediately (p.c's advice from the 2nd incident). I do work fulltime and the school are kindly escorting my son home from school every night and also collecting him in the morning, which is great.
However, can I get a restraining order against this person and if so how and do they work?
Any advice would be greatly received, many thanks xx

I would have thought that if he is on Police bail then they should have attached conditions to the bail that he doesn't approach your son or interfere with witnesses. Keep a record of any further threats and pass these on to the officer in the case to strengthen your case.
I work in police stations dealing with offenders like the lovely individual you mentioned. First,he is not going to kill your son,many kids do this in retialaition,and to big themselves up.The police should have put bail conditions on,not to contact directly or indirectly your son,which means what it says,in person by phone,msm,text,letter etc.Alos it applies to sending one of his mates round to do his bidding.Contact the police again,and ask for the bail condtion to be put on if it hasnt been already. If your son has a mobile ask the school to let him keep it with him until the other boy goes to court, just incase a teacher or something cant be raised and your son spots him and needs to call 999 himself.
Thanks guys... Revel, I was told by the police station, not sure if I spoke to an officer or a civilian working there but they said there was no conditions on the bail at all, can this be right? If so, can I get a restraining order, or non contact order as its now called? The police are on their way back again tonight, they have just called, so I dont know what that will be about.
Hope everything works out ok - I taught in a large secondary school for 16 years and I was intimidated by students, followed home in cars, spat at, sworn at, had to rescue a girl from a toilet who was being held at knife point by her boyfriend, pushed and shoved (and some of these things happened when I was obviously pregnant) - there are some right nasty pieces of work out there and I hope this lad gets what he deserves. Try not to worry.

Do you have the collar number of the officer who is related to the case?
If so, my suggestion is that you go into the police station where he is based and ask if you can speak to him, if he isn't in the station, ask to speak with somebody else. Explain your situation, that the lad in question is currently on bail and has made a death threat to your son and your worried about what actions this lad may take. Can there be a charge of making threats to kill be brought against him (providing that you / your son is wanting to make a formal complaint AND has the chat log from msn in which this lad has made the threat). If so, then futher to the formal complaint being made, is there a possiblity his bail can be imposed with conditions such as no contact with your family or not to go within a set distance of your family especially your son ho was the last to be attacked.

Hi Simon, we definately now know that there are no conditions set on his bail, the police officer came out last night to take another statement for the victim intimidation statement or something like that, we did take a screen shot of the death threat and printed it off for evidence/exhibit. Thats all I know at the moment, when I call the station I am promised a call back and that never happens though.
seems like it has not turned up reason being I am not sure however basically what i did actually reply to you in some length/details was contact police, if they dont do so with you by about 12/1 o clock as its that time now unless theyve rung u, ring them and insist on somebody speaking with you on the phone and most deffo the way forward from this point, firstly would be adding set conditons to the unconditonal bail which is what he is currently on, why i dont know
