Hi, i run a sports retail business and i have recently directed my web developer to link all my Ebay products with my website products. in this process they have made a mistake which has ended all my Ebay listings, this has resulted in me losing all my sales history for the items and will result in me losing money through Ebay, it will take around 6 months to get back to my previous position. Some of my products I had sold over 1000 products and was always at the top of Ebay search results until this happened today.

Can I make a claim from the developer due to the loss of earnings?? 95% of my sales are from Ebay sales and this could have a serious impact on the company.

It's extremely unlikely that the developer will write out a nice big cheque unless you've obtained a court order compelling him (or his insurer) to do so.

So you need to ask yourself these questions:

1. Am I prepared to pay the court costs of what could to turn out to be lengthy litigation? (The court would probably order the developer to pay those costs if you win the action but you would have to take the risk of losing) ;

2. Can I quantify my losses in such a way that a court would be able to correctly assess my losses? (It's no good simply saying "I've lost x thousand pounds". You'd need to provide evidence to back up your claim) ;

3. Can I show that my losses have come about through the negligence of the developer? (Simply showing that the developer undertook a particular action, which he could not have reasonably expected would be to your detriment, might not be enough to win in court. To be certain of winning you must prove 'negligence').

If the answer to all three questions is 'Yes' then consider seeking compensation. If any answer is 'No' then you'll probaly only be 'throwing good money after bad' by pursuing a claim against the developer.
