ebay strike

I've been using ebay now for months without any problems.Last week my boyf bought some forkseals for his bike for �35 the buyer asked 4 postal orders so we wrote his name on them and sent them off,a few days later they arrived completely rusted with chunks taken out of them,we politely informed the seller and he sent back abusive emails saying that i was a cheapstake for buying 2nd hand,He then when on to get us a strike for non payment with a dodgy cheque he also claims i sent back a faulty item neither of these is true and he cant prove this cheque exsists or that i send a package back although i can prove the postal numbers!I cant believe how this conman has turned the tables on me and he his a complete liar!What should i do next other than keep e mailing back and forth and getting no where fast!please advise it would be greatly apprieciated!!

Open a dispute using the 'goods not as described' option. I hope you saved the counterfoils of the Postal Orders as you will need them to prove that you paid him. Good luck!

Thank you for your answer but i didnt explain properly i have opened a dispute and we have been emailing back and forth getting no where and the cheeky sod has opened a dispute on us and got me a strike 4 not paying!I cant believe someone could lie so much he claims he recieved a cheque then sent the goods then he realised the cheque had bounced i have asked him to proof this if i sent a cheque surely he can prove it bounced in his bank and he would have a check number!i do have the counterfoils from the postal orders and i put his name on them.He also claims i sent the item back in the condition he sent them to me,he doesnt answer any of my questions about the cheque just keeps saying pay up i really cant believe the cheek of him what shall i do it is impossible to get hold of EBAY

Try posting this question on the Q&A forum on e-bay. (go to community boards then discussion and then Q&A) There are a lot of seasoned e-bayers on there who can give you much better information and advice than I can. Good luck!

Ebay are great at keeping records of transactions, but aren't much good at sorting out problems on them. They're unlikely to help you much. Paypal would have been more help, but you paid 'cash'.

1/ Give him bad feedback. But, if you think you can get an alternative solution (as below), wait, as you can't repost or amend feedback. If you know a 'techie', you can point the feedback at a specifically created website, wherein you can really go to town, without length limitations!

2/ If you can prove you paid him (you have the PO counterfoils) and that he took the money (the Post Office should be able to tell you) and that the goods he supplied were c**p (you still have them) then take him to the Small Claims Court. It's cheap (�40 I think, and free if you win, as he pays the costs!), simple and you can do almost all of it on the 'net. All you need is to download the forms, to be able to write an account of what happened and have the proof. A caution though, even if you win, getting your money is a different matter; if he's the t**t you make out, he may just ignore the judgement. He will, however, get the judgement recorded against his name and on his credit record - somethign normal people would do a lot to avoid.

3/ If you don't want to pursue this you may have to just write it off, put it down to experience (of life and Ebay) and adandon your Ebay account for a new one. Also, change your email address so he can't keep hounding you.

PS If you do win in the Court, I'd imagine you could send proof of this to Ebay and get them to a/ erase the dispute against you and b/ close the one you raised against him in your favour. Job done.
