I have posted a question before regarding a faulty sofa. The retailer has told us we have to accept a replacement of the same kind even though we have told them we do not want one we want a refund as the leather is of exceptional poor quality and has started to split after only a few weeks. I have been on to our credit card company who said they are passing our information on to there investigation team, but said the retailer is within there rights to offer a replacement. We are in an awkward position at the moment as the store keep phoning saying the replacement is ready for delivery, but are still hanging on to hear from the credit card people. Does anyone know what our rights are and should we get our money back from the credit card people. Thanks.

only the cc company will know. Even if someone on here has been in this position before, it wont help answer you query, because that will just be what happened for them, not you
surely you are entitled to your money back if the item was not fit for purpose A sofa that splits after a few weeks would surely meet this criteria. I'd give trading standards a call and tell the retailer you are doing it.

You haven't answered any of your other 3 questions at all and you haven't explained what TS said when you contacted them
Did you open and read the links I sent in your last posting. If you google 'Sale of Goods Act' there are loads you can read up on all giving the answers you may be looking for and showing sample letters. Also google credit card regulations and claiming money back. I am sure all the info is there.

Thank you furrypusscat for all your help it is much appreciated. I did contact Trading Standards who told me the retailers were within there rights to offer a like for like replacement, but that we also had rights to say we wanted a refund, they just told me to put everything in writing to the retailer which I already had done. We contacted the credit card people who sent us out forms to complete which we did and sent all other relevent documents with it. They have now said the same that the retailer is well within there rights to offer a replacement and are passing on our information to there investigation team, so hopefully we will hear from them soon. I will let you know what happens next and thanks again furrypusscatl
