I have tried to update the software on my iPhone 4 but I am getting this error message :::

"The iPhone software update server could not be contacted ----- Make sure your networks settings are correct and your network connection is active, or try later"

Am I doing something wrong or is the problem at their end?

Could it be the internet, are you doing it over wifi? Try through iTunes.
