I have been in court of ABH, I have pleaded not guilty. I was wondering which way the case can go?
BACKGROUND INFO
- me and and 3 brothers got into a with a guy, he attacked us first which is seen on CCTV
- my role - I did not hit anyone that night, ON the CCTV their is no evidence to show I hit anyone that night. However my brother had a weapon, I removed this weapon. It may look like I was hiding the weapon, but I know there is CCTV outside and inside, so hiding it is a waste of time. AT the time I did not want anyone to pick it up.
-One of my brothers has 3 charges, he has pleaded
-my other brother with ABH has pleaded in self defence.
what do you think the likely outcome is for me? my brothers said I did not hit anyone, the CCTV shows that I did not hit anyone.
There are witnesses.
The witness did not see the whole thing, but they say 3 males were attacking . This is what they basically say. They could however not identify between me and my younger brother as we were wearing the same clothes.
We can't say what will happen. You must get a lawyer, he/she will be able to view the evidence and advise you.
This is serious, the use of a weapon could make this a prison sentence. Get a lawyer ! Hiding a weapon can be as serious as using it.
I hope common sense would prevail - but a weapon is serious and you cannot prove that you were not hiding it. You need a lawyer. They will also question if you knew that a brother was carrying, or likely to carry, a weapon. If it was the one with 3 convictions then you are on dangerous ground. You definitely need a lawyer. I believe you, but that's not the point I'm afraid.
I am not the one with 3 charges. I only have one and thats for ABH. I have not been charged for anything connected with the weapon. The police have seen the weapon ( a stick) on cctv, so I dont think it matters that they didnt find it. I knew there was CCTV. So why would I even try to hide a weapon if everything can be seen?

You don't have to "push for a trial". All you need to do is to maintain your not guilty plea and you will get one.
One thing to bear in mind is that if you are convicted following a trial, apart from anything else (prison, community order, fines or costs), you will pay a "Criminal Court Charge" of £1,000. This is a fixed sum which cannot be varied by the court. (This assumes the offence was committed on or after 13th April 2015).
Yes Eddie is right. If you are fund guilty you will face a bill for at least £1,500. This is just the Criminal Court Charge and a contribution towards prosecution costs. You will also pay a Victime Surcharge (depending on your sentence up to £80). Then of course you will receive whatever sentence the court sees fit.
If your solicitor believes you are not guilty then you should continue to plead that way. But you neeed to be aware of the potential penalties if you are found guilty.
Hey guys, thanks for the replies. I will be pleading not guliy. My lawyer does think there is potential to win the case.
The CPS have withheld the CCTV evidence. What reason do they do this for? The wtinesses did not see the start, but the CCTV shows the other guy hitting my brother first and it also shows me not hitting anyone, but close to the scene.
Incase I lose the trail, can I still be a management account? I read that you cannot be a charted or certified accountant but it doesn't mention management accountant. Or Am i banned from any careers in fiance?
