Case So Bad, Jury Excused From Service...

Mr Shivvy is the (currently dubious) proud owner of this car however recently, it has started refusing to start. Initially it seemed to be something to do with the immobiliser because on one occassion it started after we both turned off the bluetooth on our mobiles!!
However in recent times it has become more temperamental - and more regularly. A load of months ago the gearbox went so he sourced one privately and had it fitted. It is in the Merc garage now and they are saying that the gearbox is not compatible enough and that maybe the problem (ie they won't touch any work that was done outside of a Merc dealership!)
Anyone else got any ideas?
I don't know if this is significant but before it started to refuse to start regularly, it had been acting strangely. He used to park it headfront into the drive so when it was time to reverse it out in the morning, it would take it 3-4 times before it would reverse. It would engage but then conk out 3-4 times.
Clearly I am clueless about motors (!!), but I would love it if an ABer could shine some light on this prob.
