buying someones upgrade mobile phone

if i buy an upgrade it will be registered to someone else even if i put my own sim in and so they can even tho i cant see why they should have an incentive theoretically get it cancelled once i buy it right?
so is it a risk for me to buy an un opened upgrade rather than a mobile registered in my own name from my network?

If it's someone you know, then I can't see a problem but if it's a stranger, you have no proof it's an upgrade rather than stolen. Having said that I have bought several phones form the local classifieds and never had a problem...
