I am stumped as to why, although file sharing networks (such as Kazaa and morpheus) clearly infringe copyright (secondary, s22-26, CDPA 1988) they are not stopped?

Because file sharing technology does not infringe copyright: people utilise file sharing techology to infringe copyright... In precisely the same way your car doesn't break the speed limit: you utilise your car to exceed the speed limit. In precisely the same way money doesn't break drug laws: but money can be used to buy drugs. In the same way a gun doesn't murder people: people use a gun to murder people. You simply can't blame a legitimate tool or technology when people utilise it for illegitimate means.

Incidentally I applaud the way in which the record labels actually fight these tools. Suing everybody is stupid and attacking their machines is a case of two-wrongs... (the sooner they stop this the better). However, flooding Kazaa and the suchlike with false tracks is perfect. Those tracks cannot be legitimately found there so they're attacking the right place, they don't inconvenience legal users of the P2P software, and it isn't as childish as suing people left right and centre. One day they'll replace their white-noise tracks with ones that contain a 30 seconds sample followed by an advert for a legitimate online music site, and we'll all be happy.
