w595 battery rubbish?

my battery in the phone has just started to loose its charge..big time its only 2 months old and ihave always charged it right down everytime help??
its from 3 bought from their teleales do i have a leg to stand on....also havnt got insurance with them

the latest "intelegence" on LiLon is that you actually can damage them by leaving them on charge ....
you can also damage them by over discharging them ...
and leaving them unused with more than 20% is pretty distructive also.
I only have a work mobile ... which stays plugged in when I can ... and gets run to totally discharged when I have to ... and after 18 months still gives exactly the same standby time as when it was new.
so yours seems a bit extreme .. but I think the rule on guarantees is 12 months .... batteries not included.
you could try taking it back for nothing ... they can only say no !
