i was driving in a very slow and busy road, i was trying to check my mobile for time be cause my car time wasnt working. suddenly i got stoped by an officer saying you "you have your mobile while driving", i admit that i had my mobile on my hand when he stopped me, but i wasnt even using it as i have a bluetooth. i was tring to explain but he wasnt intersted atall. iam a PDI instructor and held a clean driving licence for 7 years. what shal i do with the points and how long would it take to remove?? many thanks.....
Points remain valid for 'totting up' purposes for 3 years but you can't get them removed from your licence until a further year has passed. (For some types of motoring offences points must remain on a driver's licence for 11 years, but that's not relevant to your offence).
You were using it, it was in your hand, and you've said you were checking the time. You don't have to be talking on it. Not gloating, just explaining that technically, you were using it. Can't offer any help elsewhere though, and I know what you mean about a clean licence, cos I have points for speeding - the only time in 30 years, and that was a momentary distraction that caused that.
Jimmy Carr recently got off on a similar offence due to a technicality. His solicitor argued that he was simply using the phone as a Dictaphone to record some new material, and as such was not using the phone facility. Don't forget to inform DSA of any points. They will find out if you don't and that will make it worse for your chances of being accepted onto the DSA register. Best of luck
