Cyclist using mobile phone

if i were to knock down a crclist who was using his mobile phone with one hand and riding like a moron over a roundabout in the dark would i be in the wrong if i had tried to slow down and avoid him but he veered into my path because of only having one hand on the handlebars whilst he was talking on his phone, even though he was in front of me?

There are too many variables for me to pass judgement here eg. what do you mean by "riding like a moron" ? Did he have lights ? how fast were you going ? etc etc
Personally I believe a cyclist should not be on the phone or any other device that has him riding one-handed for a more than reasonable period of time.
