bb problems

my cousin had her a black berry phone for 3 months ago and recently it wouldn't turn on and wouldn't charge or show any sign of doing anything so I took ity back to carphonewharehouse. They sent it off to BB for repaair who sent me another phone. Got another phone two weeks later and it was basically falling apart turns its self off and on when it feels like it sometimes it won't let me see what I'm writing so she's took it back again, she's only had the new phone 5 or 6 weeks and they said alll they can do is send back off to blackberry again and they don't control what they give out, cpw told her that bb can do whatever they like and just seem to keep being fobbed off by cpw.
i do know from personal experience that after the 3rd phone has gone back they have to exchange for new handset , either same or different model as i've done this with o2.

my cousin wants to know what the best course of action would be?
would it be to take it back to cpw and let them send it back off, complain to bb or should i tell her to ring vodafone to explain the situation and let them fix it?

Surely the "contract" is between the purchaser and the shop, not the manufacturer.

Same problem with BB curve 8520, keepts turning itself off, so I wedged a piece of toothpick under the battery and it's Ok but as I bought it in England I can't take it back til I go there. I did write and fax Blackerry and they have called me several times and were very nice, but I do have to take it back to phones4U. Vodafone won't do anything.
it would be much much better for the person who's phone it is to sort it out. If you have both taken it back at different times and both use it, no wonder it's getting confused. I cant see how CPW would deal with anyone but the contract holdre though

bedknobs - its my cousins phone, only she uses it (i only put the question on here to try and get her some advice).
i have told her to contact bb and also told her to contact voda as its on contract and it's not fair that they send a phone thats already been repaired previously (someone else's) as she kept getting bb messages off some ppl 150miles away and the casing on the side is coming away (can't believe bb are happy to send someone a phone in that condition),

alba - you're right but has she went to cpw for the phone and voda are the network, its voda that she recieves the services off and thought if she were unhappy with what cpw had done or told her then voda should be able to deal (i know i can book my phone in with manufacturer or o2 if a repair is needed)

netibiza, i'll get her to contact bb and i think her phone is a curve (not 100% sure, not up on the bb's)
i have told her though that after 3 attempts she can have a mutual exchange of handset so have said maybe cpw would be best option has when it comes back or a different phone comes back then its the 3rd one. (all she wants is 1 that works)
