What Can I Do Legally Here, falsely Being Charged For Public Intoxication/endangerment
2 Answers
I was at a upperclass nightclub over the weekend, and as a few of my buddies(a few of which were severely intoxicated) and I were walking through a narrow hallway towards the bathroom, my bigger friend lost his balance and pushed me causing me to bump up into a guard. The guard immediately snapped and threw me outside and while on the sidewalk literally the moment after this man "physically" escorted me out, I was trying to explain myself reasonably to him, I apologized about 500 times and tried to tell him it was all a huge misunderstanding" . The man told me to "flump off" and said i wasnt gonna be able to get inside, so i asked him if i could get my coat from coat check and he would not let me . So at this point while standing on the public sidewalk right in front of the club i take my phone out to call my friends inside(my ride specifically) and tell them that ive been kicked out, the man starts pushing me in the street telling me to leave. I told the man that as a Us citizen i know my rights and can stand freely in public. The man pushed me off the sidewalk into traffic. So I immediately pull out my cell phone and call the police. The man comes into the street and slaps my phone out of my hand and hits me. So i pick up my phone and run away from this man callign the police and place my call stating that i am being physically assaulted harrased and having my constitutional rights violated in public. After my call has been placed i walk back towards the man and start recording him with my phone stating that the police have been contacted and that they are on the way. A different guard came and told me that they had already phoned the police before I even had a chance, and the guard pushes me again into the street and grabs my phone and throws it to the ground. The guards were laughing at me saying that i couldnt do anything because they would tell the cops that i was drunk and i would be arrested. (I had only had 2 pbrs i drink vodka reg) The officers arrived seconds later and they seemed to know the security by name, after the security spoke to the police i tried to explain my story and told them that i wanted to press charges. The officers refused to take my complaint seriously and said i was the one at fault. So I pull out my video camera and start recording them asking for a supervisor because i felt my constitutional rights were violated and i wanted to have my complaint be met in a proper manner and press charges. I was asking for badge numbers and police names the officers told me they did not have any of these and the female cop tried to physically grab me and take my phone from me, so i step back off the curb in to the street, away from her trying to record everything that is taking place. The male officer says, "hes intoxicated endangering himself" and cuffed me right there. They took my phone from me and put me under arrest. Immediately after reading my rights i say I wantl to speak to my lawyer when the first opportunity arrises. The officers took me to a station first, as a stop to pick some one up on the way to holding. The officer "promised" that i would have an opportunity to speak to my lawyer the moment i arrived at the holding cell. Upon arrival at this holding cell i am given away to different officers who have no idea what i have done at all and told for them to process me. I stated that i was told i could speak to my lawyer or a police supervisor and that i felt i was being treated unconstitutionally demanding to go to a hospital to prove my condition.(said this at least 20xs)They flipped and threw me in a holding cell for 8 hours, denying my right to a lawyer. When released i spoke to a supervisor and told her EVERYTHING( and i have her name written)my phone wasnt with my belongings, the cops took it to their station, and the videos of them refusing bades had been wiped. I have two witnesses who saw everything. Wat can I ACTUALLY do about this. I know for FACT the cops will try to cover it.
