motability discriminating against me for having past problems

im 39yrs old & in september 2011 i was diagnosed with Advanced lung cancer making me eligable for full DLA Under special rules for Cancer but after ordering my motability car from a dealer i was told my application wouldnt be accepted for the reason being that 4yrs ago i reached a tot up of ponts on my licence for which i had a court accept responsibility for the fact ther was no evidence to say i was proparly informed i was disqualified wich then forced upon me a charge of driving whilst disqualified a month later but after the court accepting mitigating circumstances with no supporting evidence they thought it would be wrong to add any extended ban upon me but endorsed my licence with 8 points
i thought the whole idea of being awarded full DLA with Higher rate Motability was to assist in giving a person who has been disabled from ther life through terminal illness an opportunity to be mobile with worry free mobility access & DLA is awarded to give a disabled person assistance in improving ther way of life from the position that has forced on a disability which disable them away from ther normal way of life

i feel that with Motability refusing me access to the scheme the reasons given is discriminating against me due to havin a difficult time in the past so they are using my past against the unfortunate position i am living in today therfore i feel they might as well say that
i should of thought about this whilst i was making silly mistakes 4yrs ago but it was never even a thought in my mind that i would ever be in the situation to reqire help at any time

i feel that what they are saying is totaly wrong & the whole reason i was awarded full DLA was to help me in my current unfortunate position but cause of a mistake made 4yrs ago they are refusing me the right to obtain the benefit for which i have been awarded


what can i do about getting help with dealing with this as my cancer has damaged the nervous system around my voicebox so i am unable to speak ????

Motability is a charity. You have been awarded DLA but that doesn't give you an automatic right to a Motability car.
they have their rules for a reason.

maybe ask for a dealership lease car with the money?
Mobility allowance can also be used for paying for taxis etc

The problem is with Motability they pay the insurance as well as providing a car or money towards one and you are such a high cost to insure because of the driving offences it would not be in any way covered by you giving up your mobility allowance which is used to off set some or all of the costs. Its unfortunate but it sounds like they are making a fair decision based on their responsibilities as a charity.
The recipient of DLA does not have to be able to drive to get a Motability vehicle. Have you got somebody you could nominate as the driver?
also, i thought you had to be awarded the mobility component for a period of 3 years to be eligible for the motability scheme?
this from the motability website
"To lease a car through Motability you must have at least 12 months' award length remaining"
you simply do not qualify because "special rules" as i'm sure you know means that it is estimated that your life expectancy is less than six months

well it answers the question. The definition of terminal illness for special rules is social service's - not mine
