Hi all, im so stuck and scared and i dont know what to do!

I booked a holiday to florida with my girlfriend for next september, but last month i was arrested. Previous to this i did not have a criminal record. I stupidly decided to drive her car when drunk, no license or insurance and a tiny bit of cocaine. In court they dropped the cocaine charges as i had tested negative to the drug when they tested me at the police station. I was given a £400 fine and 2 year ban. I am 22 years old now 23 next year. One stupid mistake had lead to ruining a holiday of a lifetime that i have been saving and dreaming about for years.

Do i apply for for the VWP? I know a single drink drive offence is not moral turpitude but im guessing without a license and no insurance probably is. The cocaine was dropped so i guess i still need to inform the embassy of my situation.

Read loads about people not ticking yes to the arrested box and walking through just fine, but i dont wanna risk it if i am not gonna get through. I dont know what the us immagration officers can see on there computers when they scan my passport.

Im so stuck, end of the day im a 22year old lad who made a stupid mistake wanting to go to florida with my girlfreind. I am not a terrorist, i am not a risk to the americans!

My informant who knows such matters, says that you could well come unstuck as there is an exchange of computer information between US and UK. He suggests you make a formal written enquiry to the US embassy and then you will know exactly where you stand. If bad news, live and learn. If good news enjoy your holls with a clear conscience. I hope you, as a young man will not do such a foolish thing again.

Go with VHGs advice on this. If you contact the embassy, you'll open up a can of worms. Americans are hysterical about crime, especially drugs.

They won't find out unless YOU tell them!

As VHG states, the USA has no direct access to UK criminal records; EU legislation prohibits the UK from passing on such information. However a great deal of information does seem to get forwarded as (nominally) part of anti-terrorist activity (which is exempted from the EU prohibitions), even though almost all of that information has absolutely nothing to do with terrorism.

You'll be taking a significant risk if you apply to enter the USA under the Visa Waiver Program. It would probably be best to apply for a visa but time is already very short. The longest wait I've seen reported here on AB was one of 15 months before being turned down because of two convictions of driving without insurance.
