i done work for my brother in law for over 3 years while being a carer for my mother and on benifits. Before and after my mother passed away. He paided me cash in hand different amounts also a holiday to india for 2 weeks. He never paided any tax or national insurance, for me for over 3 years. He says now that i,ve refused to work for him again, he,s threatened to tell the benifits office i accepted money off him while claiming benifits. Could i tell the inland revenue about the non payment of tax while i was working for him ??.

You can paint it anyway you want but you took the taxpayers money and topped it up with your money from your brother in law.
Your brother in law will not report you because he also was in the wrong. He knowingly employed a person on benefits knowing that they were not legally able to do so. Challenge him and say 'i will work for you again if you employ me in the correct legal manner. We were both in the wrong last time and i will not make this mistake again. You also broke the law when paying me cash in hand and so you will also be in trouble by reporting me'
Think of the money you took from the goverment over 3 yrs when you were working. thats alot of money.; You'll have to pay this all back. Whilst i think you deserve this, you will be stupid to tell the inland revenue now

It is up to the individual to declare all their earnings NOT the people that "employ" them. Your brother in law could easily say that he paid you cash but it was under the PAYE limit he can deny that you told him you were still claiming benefits. Keep your mouth shut and hope that he is blowing hot air, although a bit of me hopes that you do get found out. I have worked, legally, for years and paid all NIC and taxes. My last holiday was 2 years ago. India...... Lucky you.
