It's in New York harbour so I'd say New York.

The Statue of Liberty is located in the State of New Jersey. When the repairs were made to the Statue many years ago it was paid from New Jersey State Tax.
The official mailing address is:

Liberty Island
New York, NY 10004

So according to the US Post Office it is in New York.

Liberty Island has been the property of the United States government since 1800, and until 1944 served as a military installation called Fort Wood. It has been operated by the National Park Service since 1937. The built portions of Liberty Island (as well as 3 acres of nearby Ellis Island) are under the jurisdiction and are part of New York City.
If you look on google maps - It's in New Jersey - The state line runs right though the middle of Hudson river.

So the federal authorities seem to opt for 'New Jersey' as the preferred answer to your question. However it's not as simple as that because, despite its location, the built-up parts of Liberty Island (which is Federal property anyway!) are under the jurisdiction of the City of New York.

(The extensive restoration project was completed on time and budget. Only private funds were used to pay for it as well as restore much of Ellis Island...)
Trick question - New York city is in New York State.

But what is the capital of New York State.

And if you talk to anyone from New Jersey, they are adamant that it is in the state of New Jersey.
When I was in New York I remember seeing some postcards or something that said the Statue of Liberty was in New Jersey.
