Car Accident With Expired Road Tax
I had an accident last week, subsequently found out I had no car tax. I usually pay DD but it didn't renew and I hadn't noticed. I've now paid arrears and have tax. Can the instance company find out that I wasn't insured at the time?
Am I still insured?
The accident wasn't my fault however the other party has magicked up a witness and making up details that my insurance company can't fight as I have no witness, as there was no-one else there.
My car is a write off.
Please let me know if you think my insurance will be void.

If a car has no road tax then insurers are still obliged to pay out for all claims. Despite committing an offence by not having tax, this is irrelevant to the accident and the insurer. A car can legally be on the road without tax if it's going to a pre-booked MOT test - during which the insurance is not invalidated.

ok myth busters, contrary to popular belief legal transgressions DO NOT generally void insurance, if that were true every prosecution would also have a matching no insurance prosecution, patently silly. So you are insured so the fact that you have no tax only matters as a device for the insurance company to use to reduce or eliminate payout. As there is a dispute about fault, tell your insurers and let them fight it out. Your insurance is NOT void.
