Is it up to the employer if they pay you sick pay, or is there a law to say they have too?

If you earn more than £112 a week your employer may have to pay you Statutory Sick Pay.

Statutory Sick Pay must be paid - after the waiting days (I think it is currently 3) and up to a maximum of (I think) 28 weeks. The employer can claim some or all of this back from his NI contributions.

Any other sick pay is at the discretion of the employer

They have to pay the Statutory minimum but do not have to pay your full wage. There are also eligibility criteria.
