I've Been Waiting Since Monday For A Delivery Of Heating Oil.

The other day I noticed a lorry from the company I use delivering next door. If they've filled the wrong tank have my neighbours got an unexpected, warming, present?

If it can be sucked out of the tank, I suppose the oil company could take it back. If it's been used, I presume the neighbours could rely on an estoppel argument. I think the interesting thing would be if the neighbours said that you could, in theory, take back your oil ... but not our oil that was already in the tank. given that the two oils will have mixed, it is thus...

But not at your expense.

Even if they have inadvertently filled the tank next door, the oil company still have to supply you with the oil for which you have contracted.

Sam was too clean shaven. I changed the picture to better reflect the new, bearded, me.
The oil delivery next door may just have been a coincidence.
I wasn't sure if it was Charles Darwin, or one of the guys from ZZ Top.

The ZZ Top guys have more colour in their hair. I needed an image with silvery flowing locks.
Will the neighbour's get to keep the oil? Assuming it's been delivered to the wrong address.

I think the interesting thing would be if the neighbours said that you could, in theory, take back your oil ... but not our oil that was already in the tank. given that the two oils will have mixed, it is thus impossible to take back the oil company's oil. If the oil company don't have a contract with the neighbours, then there is no applicable "retention of title of mixed goods" clause ... so I think the neighbours would get to keep the oil.

Have you asked the neighbours yet? Have you asked the oil co. As an aside, it's a good price at the moment - I've just taken 799 litres for £332.64
Hopefully the neighbours have oil fired heating, or they'll be a bit peed off.
.......and no fish pond.
