Nobody has answered my previous question. In the retrial will the accuser have to give evidence?
I would imagine so hc. But it may well be in secret, or with press and public excluded to protect anonymity.
It must be an absolute nightmare for her.
Indeed.

I would never wish to stand in the way of due process, but if the operations of the law deem that Mr Evans is entitled to a retrial, and that does mean further appearances for his alleged victim, then that is a very sad and distressing aspect of the case.
//It must be an absolute nightmare for her. //

Of course Evans and his family are loving every minute of it.

Although I have every sympathy for Mr Evans' family, you must concede that the entire situation is a direct result of Mr Evans' conscious and deliberate actions - the alleged victim was in the wrong place at the wrong time.
//Does this mean the victim will have to go through the whole court evidence thing again? //

Not entirely sure who the 'victim' is here. I have my doubts that it's the accuser.

Do you have a reason for that viewpoint?
//you must concede that the entire situation is a direct result of Mr Evans' conscious and deliberate actions//
Evans was an idiot, no doubt. Stupidity is not yet a criminal offence. The jails would be more crowded than they are now if it was.

//the alleged victim was in the wrong place at the wrong time.//

We don't know that do we?
Yes we do know that. It's on CCTV.
Togo - ////you must concede that the entire situation is a direct result of Mr Evans' conscious and deliberate actions//

But Mr Evans was not convicted of being an idiot, he was convicted of being a rapist, which is not quite the same thing.

It is for a court to decide, again, if he is guilty as charged.

//the alleged victim was in the wrong place at the wrong time.//

Yes, I will concede that point - I can hardly argue the power of evidence and due process and then speculate.
We don't know that do we?
andy-hughes, //Do you have a reason for that viewpoint?//

I have always had my doubts about his conviction – just as the Court of Appeal has had its doubts about his conviction.
Is there new evidence & when did he get out of prison?
//Yes we do know that. It's on CCTV. //

The cctv images prove that the victim was there, purely by chance? We used to think the moon was made of cheese when we only had indistinct grainy images.
Wrong place, wrong time. Had she been 10 minutes earlier/later it wouldn't have happened.
//the alleged victim was in the wrong place at the wrong time.

/// Yes, I will concede that point - I can hardly argue the power of evidence and due process and then speculate.///

I will put that as I wrote, with my full comment inside the quote notation.
//Wrong place, wrong time. Had she been 10 minutes earlier/later it wouldn't have happened.//

I take it you are convinced that the victim was there purely by chance. Evans must be relieved that you will not be serving on the next jury.
Ummmm, //Wrong place, wrong time. Had she been 10 minutes earlier/later it wouldn't have happened. //

What do you mean. This is from the original trial.

//The court heard that Mr McDonald [who was acquitted of rape] met the woman and took her back to the hotel room, //
No...she willingly went to the hotel. She willingly had sex with the other bloke. It's Ched Evans involvement that's under question.
Ummmm, so why your post at 11:54?
