If you leave a job without giving in your notice, are they allowed to stop your; week in hand, holiday pay and night out allowance that you have already earned?

If it states it in your contract of employment that if you do not fulfil your notice, they can withold your hol pay then thats exactly what they can do. I don't know about night out allowance. With regard to week in hand, as far as I understand, you have worked for that and its money you've earned from the previous week, so I imagine you will be able to have that. Hopefully someone more in the know will post after me, but certainly you can lose any hol pay you have earned, if you don't work your notice.

You are required by law to give one weeks notice of resignation if you have worked for the firm for over a month. Your contract may specify a longer notice period is required.

If you don't work your notice period you are in breach of contract and theoretically your employer could sue you for damages - if he has to pay overtime or take on short term staff before he can find a permanent replacement.

This is highly unlikely - but it will not look good on your reference.

But you should still be entitled to your earned pay and untaken holiday pay.
And if you work for an employer who does not honour his obligation to provide you with a contract?. I`ve worked for 38years in several jobs and only ever had 2 contracts, and I know that I am not an isolated case.
